Surrender of DIN

Overview

Director Identification Number (DIN) is a unique Identification Number allotted by the Central Government to an individual who intended to be appointed as the director of the company or to an existing director.

DIN can be surrendered by the DIN holder provided he has never appointed as director in any company and has never used his DIN for filing any documents with any authority.

CONDITIONS FOR SURRENDER OF DIN

If any DIN holder wants to surrender his DIN than he shall fulfil following conditions:



  • He has never been appointed as the director of any company.
  • He has never used his DIN for documents filing.

PROCESS OF FILIG FORM DIR-5

  • Download the form DIR-5 from the website of MCA.
  • Fill in the required particulars.
  • Affix required attachments.
  • Digitally sign form by the DSC of the DIN holder.
  • Certification of form by professional.
  • Upload the form on MCA portal and pay prescribed fees.
  • On approval of surrender Approval Letter will be issued by the registrar.

MANNER OF SURRENDER OF DIN

The DIN can be surrender by making application in form DIR-5 to the Central Government with the requisite fees and documents required.

PARTICULARS OF DIR-5

Following particulars shall be filled in this form:



  • Name of the applicant.
  • PAN number of the applicant.
  • Permanent address of the applicant.
  • Reasons for surrender of DIN.

ATTACHMENTS OF DIR-5

  • Identity proof of the applicant such as PAN card/ Aadhar card/ Passport/ Driving licence/ Voter ID card.
  • Proof of residence of applicant.
  • Any other optional attachments if required.

Deactivation of DIN by Central Government

The DIN of the director can be deactivated or cancelled by the CG or Regional Director if they find on verification of DIN application and documents any of the following:




  • The DIN was obtained unlawfully or by furnishing invalid documents.
  • DIN holder is adjudicated as an insolvent.
  • DIN holder is declared as of unsound mind by the competent court.
  • DIN holder died.
  • DIN is found duplicate.

Before deactivation or cancellation of DIN an opportunity of being heard shall be given to the DIN holder.
